1. General
This document is a public offer by LOAADI LLC (the Seller) to sell tyres through the online shop at loaadi.uz. It is addressed to any individual or company (the Buyer).
The Buyer accepts the offer by placing an order on the site and paying for it. From that moment a retail sale contract exists between the parties on the terms below.
The Seller may change this offer. An order that has already been paid for is governed by the version in force when it was paid.
2. What is sold
The Seller sells Goodyear car tyres. LOAADI is the exclusive official Goodyear distributor in Uzbekistan, and all goods come through the official channel.
Every tyre's page in the catalogue gives its size, its load and speed ratings and its season. Tyres are sold in sets of two or four; the number in a set is shown for every size.
Catalogue images show what the model looks like. The tread pattern and markings of a particular size may differ from the photograph.
3. Orders
To place an order the Buyer selects the goods, gives a name, a phone number and a collection method, then confirms the phone number with a code sent by SMS.
An order exists only once the payment provider confirms payment. Until then nothing is reserved and neither party is under any obligation.
After payment the Buyer receives an SMS with a link to the order page. The link is private: it shows what was ordered and where the order has got to.
The Seller may decline to fulfil an order if the goods are not in stock, if there was an obvious error in the description or the price, or if the Buyer gave incorrect or incomplete details. In those cases the amount paid is refunded in full.
4. Price and payment
Prices are in sum, per set, and include all taxes required by the law of the Republic of Uzbekistan. The price is fixed at the moment of payment: a later change in the catalogue does not affect an order already paid for.
Delivery is not included in the price of the goods and is shown separately during checkout.
Payment is taken online through Payme, Click and Uzum Pay. Instalments are available through Uzum Nasiya, which sets the term and conditions and shows them before you confirm. Cash is not accepted.
Payment happens on the payment provider's own page. Card details are not passed to the Seller and are not stored by the Seller.
5. Delivery and collection
Delivery is within the city of Tashkent. The Seller does not deliver outside the city.
After payment a manager contacts the Buyer on the number given and agrees a day and time. The goods are handed over at the address the Buyer gave at checkout.
Collection is from the warehouse: Yangikhayot district, Index, pavilion 8, 1010. The Buyer receives an SMS when the order is ready. Orders are not handed out at the NEST ONE office.
If the Buyer is not at the agreed address at the agreed time, or does not answer the phone, delivery is rescheduled. A second delivery is charged separately.
6. Transfer of ownership
Ownership, and the risk of accidental loss or damage, pass to the Buyer when the goods are handed to the Buyer or to a person the Buyer has named.
On receipt the Buyer should inspect the goods: check the quantity, the size and the markings on the sidewall, and confirm there is no visible damage.
7. Quality and warranty
The goods carry the manufacturer's warranty from Goodyear against manufacturing defects, on the terms and for the period the manufacturer sets.
The warranty does not cover tread wear in normal use, damage from impacts, cuts or striking obstacles, or the consequences of incorrect fitting, incorrect pressure, overloading or using a tyre for something it was not made for.
8. Returns and exchange
Returns and exchanges are set out in the Returns section of the site, which forms part of this offer.
The Buyer's rights under the Law of the Republic of Uzbekistan on the Protection of Consumer Rights are unaffected and are not limited by this offer.
9. Liability
The parties are liable for failure to perform in accordance with the law of the Republic of Uzbekistan.
The Seller is not liable for the consequences of using the goods for something they were not made for, for the result of fitting carried out by third parties, or for being unable to fulfil an order because of force majeure.
The Seller is not liable for interruptions to the site or to payment systems caused by matters outside the Seller's control.
10. Personal data
The Buyer's personal data is processed on the terms set out in the Personal Data Policy published on the site.
11. Disputes
The parties will try to settle disagreements by negotiation. Failing that, the dispute is heard by the court at the Seller's location under the law of the Republic of Uzbekistan.
12. Measures to limit and control the risk of fraudulent transactions
In this section the Seller is called the Enterprise and the Buyer is called the Customer. The Bank is the bank through which the Seller accepts card payments, and the Internet Acquiring Agreement is the agreement between the Seller and that bank.
The Enterprise hereby informs customers and partners of the measures it takes to prevent and limit the risk of fraudulent transactions in accordance with the laws of the Republic of Uzbekistan and the Bank’s requirements.
The Enterprise monitors and restricts suspicious transactions in the following ways:
- checking payments and transactions for signs of fraud;
- restricting transactions that raise suspicion with the Bank’s security system;
- using secure data transmission channels and modern information security tools;
- identifying and verifying customers when payments are made;
- temporarily suspending transactions when a risk of fraud is detected;
- working with the Bank to prevent unauthorised transactions;
- complying with the Internet Acquiring Agreement and internal security rules.
The Customer undertakes:
- not to pass their personal data, passwords or confirmation codes to third parties;
- to report suspicious transactions without delay;
- to follow the rules for the safe use of electronic payment systems.
The Enterprise reserves the right to restrict or decline a transaction if signs of fraud or a breach of security requirements are detected.
